What should we get from publix?

My niece was given an antibiotic which was filled by the pharmacy in publix . After being on this medicine for 5 days we noticed it was twice as strong as it was supposed to be. My niece was rushed to the hospital for a full exam where we were told it would take at least a week to work out of her system. She is now having tons of stomach problems as this is getting out of her system and will not eat and just cries and has diarrhea. She is only 9 months. My sister is now starting to make a list of what she wants or what we think she should get. Starting with the hospital bill. What do you think she should get or what do you know people have received from malpractice cases?
It was a liquid medicine and the pharmists just did not add the correct amount of water when he mixed it so the paperwork and bottle said it was the right amount. My sister is talking to a lawyer who says if we take it to court my sister would get at least 100,000 dollars because the jury would be on her side, This not a normal reaction diarrhea is one thing but this is 10 times worse she has messed up all her clothes and my sister has to change her sheets about 5 times a night because it will not stay in her diaper

Your sister is entitled to her medical bills ONLY. Stomach problems and diarrhea are normal for people on antibiotics whether they are the correct amount or not.

The hospital bill would be a legitimate expense to ask them for. After all if they didn't misread or had properly filled it then you wouldn't have gone to the hospital. After that though she is likely just looking for money.

since the baby can not speak for herself, the pain and suffering is going to be up to the judge, probably not more than a few thousand

Did she sign the consent form for the pharmacist went over the side effects of the drug or that she refuses consultation? This is required when you pick up any medication, and insures the patient's responsibility of the drug received from the pharmacy. She may be able to have the hospital bills paid, but making a demands' list seems a bit greedy on her part. Seriously, we all feel screwed by the drug companies, but you may need something stronger than a prescription for an antibiotic. Also, why did it take the full five days of the dosage before you read the paperwork that came with the script. The first thing I do is read the paperwork that I get with a drug before taking it.
