My father died in a nursing home in Santa Cruz on 03/17/05. I plan to file a wrongful death, medical malpractice action on his behalf. The Statue of Limitation date is coming up soon. What can I do to to stay or preserve the date. My friend said that this can be done because he did it for his mother but he is not sure about the form he used

DON'T COUNT ON THIS, but the statute of limitations for most civil filing has been changed from one year to two years. The reason I say don't count on it is that there are various exceptions in almost any statute of limitations law, and the one you are contemplating may be one of them. I suggest you contact a Santa Cruz lawyer at once. Ralph Boroff (Boroff, Jensen, Kline & Smith) does a lot of plaintiffs' work, and he's a friend of a friend of mine.

Good luck!
