my insurance does have personal injury protection coverage, but my agent said they might raise my premium and i dont want that, because the accident wasn't my fault.
if the driver at fault's insurance doesn't pay my medical bills(i had my head, neck checked, i still have headache and neck pain), then who will pay my medical bills? i don't know how much i need to pay for all the medical bills and drugs. thank you.
i have farmers, he has safeco. police report filed, no one got a ticket. i live in texas if that helps.

What is wrong with this picture? Personal injury coverage of others is the main point of auto insurance. If the other driver is at fault his insurance will pay. You may have a conflict about how much, but that is a different issue. Your rates should not go up if you are not at fault.

If you have to pay out of pocket because your insurance nor his will cover the total medical damages,you may have to sue the other driver. You would have to get a lawyer and sue the driver NOT their insurance company for whatever you feel is owed to you

If the accident is no fault, then you or your insurance carrier pays your own bills. However, if you feel the other driver was negligent, you can sue him directly. Have yourself checked out, get the necessary treatment and sue him. That's all you can do really. Sorry to hear about the accident. Hope you feel better soon.

Nobody got a ticket? Not good. I live in TX as well and if nobody gets a ticket it is very difficult to establish a true fault. His insurance may be able to deny any claims.
You can either use your insurance to pay your med bills or use your health insurance. No report filed then you can't prove anything.
