It depends on the state that you live in, and it also depends on the kind of injury. For most injuries, the statute can run one to three years, either from the date of the injury, OR the date that you learn of the injury.
In some states, where the injury happens at, say, birth, the statute can from three to 18 years. In FL, that statute runs from three years. In CA, a birth injury statute runs for eight years. In CO, it runs for 18 years. This is because some injuries take quite a while to manifest themselves.
You need to call a med/mal attorney in your state to find out for sure. Don't call a P.I. attorney who also does med/mal, but call a guy who does nothing but med/mal. And call a guy in a big city with a big firm. It really does matter from whom you get your advice.
