I had an auto accident a year and a half ago. I have been undergoing treatment ever since. I am still going through treatment and may never stop going through treatment. The lawyer has received my dr's narrative report and has sent a demand letter to the at fault insurance. My injuries are as follows:
1. Headaches
2. Cervicalgia-Neck Pain
3. Cervical sprain/strain
4. Cervical disc displancement
5. Lumbalgia-low back pain
6. Lumbar radiculitis
7. Lumbar disc displacement (L4-5,L5-S1)
8. Annular Tear (L4-5, L5-S1)
9. Unspecified disc disorder of lumbar region
10.Airbag burns to upper arm, LEFT
11.Hip Pain
12.Pelvic/thigh pain
13.Leg Pain
14.Multiple abrasions
15.Numbness/tingling
16.Muscle Spasms
17.Sleep Disturbance

My medical bills are in excess of $ 16,000 and increasing. I will be going to drs visits, getting injections, and taking medication for awhile, if not forever. Surgery is even a possibilty if I can get up the nerve to continue on with it. But from family experience, back surgery does not seem like a one time deal. They are always followed up with more surgeries, at least that is what I have observed.

I'm just looking for an estimate as to what I should expect. Or maybe what is a good offer. My life has drastically changed since the accident. I mean I am only 24 years old and I already have extreme pain everyday of my life. There is not one day that goes by that I am not reminded of that terrible accident. I am just happy to be alive. But I do think I should expect some kind of compensation due to the negligence of the other driver, whom was driving a company vehicle.

Yes I do currently have a lawyer, and they have been representing me since around 3 months after the accident, thats when i realized this could get serious.

My Lawyer has informed me that the at fault party has a million dollar automobile insurance policy.

There is no such thing as an average settlement. Just my personal opinion but being handicapped at 24 with the possibility of lifelong pain and medical bills as a result of the accident you should be asking for at least one million. You need to do some research and find a lawyer who specializes in high value settlements and has a good record of collecting. Do not hire some yo yo recommended by a neighbor, your buddys brother in law or someone whose name you pulled out of a phone book.

First, my sympathies and condolences, and best wishes for a speedy recovery.

Personal injury suits take time. In March 2005, I slipped and fell in my workplace and broke my arm; I was out for between three and four months. This past February, the defendants' counsel deposed me, four years after the event. And, the defendants have scheduled me for an independent doctor's exam next month. The suit has yet to go to trail, and even I have no idea what I may receive, provided the jury finds in my favor.

It is difficult to say how much you may receive as a settlement; given that you now must endure chronic pain for the rest of your life - and you're only twenty-four! - means you will probably be able to see money for pain and suffering.

Given that these kinds of suits take as much time as they do, you may not see any kind of settlement, either out-of-court or following a trial, until possibly your early thirties. (Remember, I was deposed four years after an injury occurred.)

Your best bet is to consult a lawyer. Not only will the other driver's insuror - that of the company that owned the vehicle - be involved, but you may be able to go after that company itself.

I look at your allegations see, soft tissue injuries. Pain is not an injury. You are not going to get the policy limit that is for sure. If you live in a No-Fault state, you probably have PIP coverage. This coverage will pay for your medical expenses. If not, any outstanding medical bills will be included in the settllement.

What state did this loss occur in? You may not even be tort eligible. You injury, by definition, does not appear to be "serious". As you already know, all allegations needed to be supported. If not, they are not going to be considered. You will not get compensated for "what ifs" either. You as the plaintiff, have the duty to mitigate your damages.

Assuming you were partially disabled for 18 months, and you may have some permanency rating(you do not say) the insurance company is probably going to want an independent medical examination to refute these allegations.

Anyway, expect a settlement in the $ 24k-$ 40k plus outstanding medicals/lost wages.
