out of pocket expenses

If you itemize your deductions, instead of taking the standard deduction, you MAY be able to claim your medical expenses.
In order to claim your medical expenses, they must be greater than or equal to 7.5% of your modified adjusted gross income, and these must be expenses for which you received no reimbursement.

Maybe. You can only claim the amount that's over 7.5% of your adjusted gross income, and then only if you itemize.

First you must be one that itemizes their deductions. Secondly you must have expenses greater than 7.5% of your Adjusted Gross Income (AGI, line 38 on your 1040 form).

Dear Michael: You can claim medical expense on Sch A. The limitation is 7.5% of your AGI. This would be out of pocket expenses that you are not reimbursed. You use the word injury and if this injury is one where you may get money as in: job related, public responsibility (broken sidewalk, etc.) you may be compensated for your expense and will have to account for that money, possibly in future years.
This advice was prepared based on our understanding of the tax law in effect at the time it was written as it applies to the facts that you provided. Click on my profile to read more.
